Terms and conditions

i. General information

These Terms and conditions ("Terms") govern the use of the Mobbe mobile application ("the App"), operated by Mobbe ("Mobbe" or "we"), with the following details:

By creating an account or using the App, you accept these Terms. If you do not agree, do not use the App.

To understand what data we collect and how we process it, see our Privacy policy.

These Terms are also available in Spanish and Portuguese. If there are differences between versions, the Spanish version prevails.

ii. Description of the service

Mobbe is a fitness training application. It lets you choose a routine or import your own with AI, log your workouts, track your weight and your measurements, and see your physical activity if you connect Apple Health or Health Connect.

In Nutrition, Mobbe calculates an estimated daily calorie and macro goal for you and proposes a meal plan that you can adjust (see section vi).

iii. User registration

To use Mobbe you need to create an account with an email and password, or sign in with Apple or Google. You are responsible for keeping your credentials confidential and for all activity that occurs in your account.

iv. Access and PRO subscription

In Argentina, the App is free for training your routine; PRO features (nutrition, changing or editing routines, AI and the rest) need the subscription. In every other country, to use the App you need the PRO subscription. Your plan is set once, when you finish setting up your account, based on the country you connect from. When you finish, Mobbe builds your routine and shows you the plans before you pay anything. Accounts created before version 1.3.0 keep their free plan.

v. Medical and training disclaimer

Mobbe's content (routines, training recommendations, nutrition information) is for guidance only and does not replace the advice of a doctor, nutritionist or health professional.

Before starting any training program, especially if you have a pre-existing medical condition, consult a professional. You are responsible for assessing your own physical condition before doing any exercise suggested by the App.

To the extent permitted by law, Mobbe is not liable for injuries or health problems arising from using the App, its routines, its goals or its meal plan contrary to these Terms.

vi. Nutrition: goals and meal plan

Mobbe's calorie and macro goals and its meal plan are automatic general wellness estimates, intended for healthy adults aged 18 or older. They are calculated with published formulas and with the data you enter, and they may not fit your case. They are not a diagnosis, a prescription or a treatment, and they are not reviewed by a doctor or a licensed nutritionist. Mobbe is not a medical or professional nutrition service and does not replace that consultation.

Do not use the goals or the meal plan if you are pregnant or breastfeeding, if you have or have had an eating disorder, if you have diabetes treated with medication or kidney disease, if you take medication or have had surgery to lose weight, or if you have another illness for which you were prescribed a special diet. In those cases Mobbe does not calculate goals or build a meal plan, and suggests that you consult a doctor or a licensed nutritionist. If you are under 18, Mobbe only shows you general guidelines, without calories or amounts.

To choose the foods in the plan we use artificial intelligence (see section viii and the Privacy policy). The amounts are calculated by Mobbe. The results are for guidance only and may contain errors: review each meal before following it. We remove from your plan the foods in our database that contain what you marked as an allergy or intolerance, but we do not control brands, labels or cross-contamination: always check the label of each product.

We do not guarantee results: your progress depends on how you eat, train and rest. If you feel unwell, stop following the plan and consult a professional. Using Mobbe to restrict your eating below safe levels is not allowed.

vii. Health data and device permissions

If you authorize it, Mobbe reads data from Apple Health (iOS) or Health Connect (Android), such as your steps, your heart rate, your workouts, your weight and your height, on a strictly read-only basis. You can revoke this permission at any time from your device Settings. The details of what data we read and why are in the Privacy policy.

To use your health and body data (for example, your weight, your measurements, your discomfort, your steps or your meal plan) we ask for your express consent. You can withdraw it whenever you want from Profile → Account → Privacy → Health data. While it is withdrawn, we stop using that data, including to build routines with AI: Nutrition, logging your measurements and reading Apple Health or Health Connect are paused, and your workouts and your routines stay the same. The details are in the Privacy policy.

viii. Artificial intelligence features

Mobbe lets you import a routine with AI from a text, a PDF or a photo. To analyze it we use an external artificial intelligence provider (see the Privacy policy). The results are for guidance only and may contain errors: always review the imported routine before using it, especially the exercises, weights, sets and reps.

• AI import is a PRO feature: you can import one routine every 30 days.
• An import counts when you save the routine, not when we analyze it.
• AI import may be unavailable at times, for example if the service's daily capacity is reached.

If you build a meal plan, we also use an external artificial intelligence provider: the AI chooses combinations of foods from our database and Mobbe calculates the amounts. Before the first plan we show you a notice and send nothing until you accept it. The results are for guidance only and may contain errors (see section vi).

• The meal plan is a PRO feature: you can build one plan with AI every 30 days, counted from the last one you accepted.
• Plans we propose when you change stage do not count.
• Swapping one food for another does not use AI.

ix. Prohibited conduct

You may not use Mobbe to:

• Impersonate another person.
• Try to access other users' accounts or data.
• Interfere with the normal operation of the App or its servers.
• Use the App for purposes other than those intended (personal training and tracking).
• Restrict your eating below safe levels.

x. Intellectual property

Mobbe's content (brand, design, routines and exercises from our own catalog, texts and illustrations) is the property of Mobbe or its licensors. Copying, reproducing or distributing that content without authorization is not allowed.

xi. Availability and limitation of liability

Mobbe is provided "as is". We do not guarantee that the App will be error-free or available without interruption. To the extent permitted by law, we are not liable for indirect damages arising from the use of the App.

xii. Minors

Mobbe is intended for people over 13 years of age. If you are a minor under the laws of your country, you need the consent of your parent or legal guardian to use the App.

If you are under 18, Mobbe does not calculate calorie goals or build a meal plan for you: it only shows you general guidelines, without amounts (see section vi).

xiii. Account deletion

You can delete your account at any time from Profile → Account → Delete account. Deleting the account does not cancel your PRO subscription (see section iv). See the Privacy policy for details on what happens to your data when you do so.

xiv. Changes

We may update these Terms from time to time. If we do, we will publish the new version on this page and update the "Last updated" date.

xv. Governing law

These Terms are governed by the laws of the Argentine Republic, without prejudice to the mandatory consumer protection rules that apply according to your country of residence.
